Celadon Lawsuit

Gavin May 15, 2021May 14, 2021

Celadon lawsuit is one of the largest and most high profile fraud cases in the history of Indonesia. It has been a mystery for the people of East Java to solve since 2021 despite several attempts by the suspects. The main suspect, Wijaya M. Babu, was arrested in connection with the murder of a local official and the rape of a Chinese girl. He is also suspected of stealing gold from the local mine.

This is not only a case of organized crime but a case of cultural cleansing and disrespect of authority figures in the local Indonesian culture.

The case is linked to the movie called “Memo Noma Mat Laban”, which translates to ‘My Friend’s House’. In this movie, which is an homage to the legendary story of a Chinese herbal master called Mimo Mamo, an English doctor played by Michael Gambon, goes to live in a villa in East Java. There he encounters Mimo and becomes friends with him.

He then gets involved in several activities including the raising of funds for a missionary project that will help the Chinese people. The story revolves around a local boss named Mochtar Momo who abuse the system and is forced to leave the country. This forces Mochtar to take his son, Lhut, to live with an American family in West Java. The local authorities accuse Mochtar of stealing gold jewelry from the local goldmine. A few months later, Mochtar is found dead in the street. His body is exhumed and discovered to contain traces of gold in it.

Celadon lawsuit was a direct outcome of this scandal. Several businessmen belonging to different cities in West Java filed a case against Mochtar for theft of property. The court ordered for a full investigation into Mochtar’s death and as a direct result of the investigation, Celadon lawsuit was filed. The lawyers working on behalf of the plaintiffs stated in the lawsuit that Mochtar had been working on a major mining project in the area. The case was delayed for some time but later in 1998, the verdict was in favor of the plaintiffs.

The Celadon lawsuit was initially ruled in favour of Mochtar Momo and was later, overturned when the Court of Appeals for West Java appealed the ruling.

After this appeal was being heard, the case moved to the supreme court. During this hearing, the verdict was once again reversed by the Supreme Court. The high Court judges cited various reasons for their decision, the first one being that the findings of the lower courts were unreliable. They cited the fact that the mining company was not properly regulated at that time and they were not sure that all the procedures followed by them were legal.

The mines in the area of South America were found to contain large amounts of sulfide. As a result of this sulfide, a local industry sprung up. In other words, there were many people who wanted to earn money from the sulfur found in the mines. There were miners, steel cutters, tailors, carpenters, and other workers working in the mine shafts. And the sulfide was very dangerous as it is capable of killing people through direct contact. Therefore, when this kind of thing started happening, the mine managers had to take some important actions to make sure that there would be no accidents taking place in the mines.

The Celadon lawsuit was against the managers of the mine site, namely Paco Peru, manager of the Paco Corporation.

The lawsuit claimed that the managers had given inadequate warning to the workers of the potential hazards in the area of the mines. They did this knowing that the sulfide present in the atmosphere could be very dangerous and thus they did not give adequate warnings. The lawsuit further claimed that Paco, along with other companies such as Gold Star, Silverton Gold Corporation, and others did not provide protective equipment and other things needed by the workers to survive in the mine shafts. This caused the plaintiffs to file the Celadon lawsuit against them.

The local court heard the case and ruled in favor of the plaintiff. The court ordered Paco to pay damages to the plaintiffs, which amount to about $5 million. However, the court did not allow the corporation to bind itself to never do such a thing again. It is up to the company now to obey the judgment of the court and prevent further damages being caused to the plaintiffs.
