Class Action Lawsuits is usually brought by consumers in an effort to be compensated for the medical expenses they have incurred as a result of the negligence of a specific person or company. The manufacturers of OxyContin have been pill popping for some time now and this is where Dr Horton enters the picture. He is currently being sued by a former OxyContin patient for wrongful death.

There are many class action lawsuit plaintiffs who have been wrongfully injured because of the actions of the defendant or his attorney. It is the duty of the defendant’s attorney to contact the plaintiff’s attorney to notify them of the lawsuit and that the lawsuit will be filed if no settlement has been reached. It is also the duty of the defendant to contact the victim and inform him of the lawsuit. The purpose of this communication is to establish and process a claim form with the help of the victim and the help of the plaintiff’s attorneys.

Dr. Horton is currently trying to get this case handled in the courtroom due to the lack of settlement.

There were too many issues with the claims and settlement amounts not being sufficient to cover the victim’s medical bills and other expenses that are associated with the case. This is a very common problem with doctors and their lawyers.

There was a claim that was filed by the wife of one of Dr. Horton’s patients who died due to the negligence of Dr. Horton.

This claim was a result of an incident in which Dr. Horton was not following the standard protocol when treating her patient. The medical care that was given to the victim was suspect and potentially dangerous. This case was settled out of court without any finding of liability on behalf of the Dr. Horton or the hospital. There was no finding of liability on the part of the hospital or Dr. Horton.

The lawyers for the Dr. Horton case have had a difficult time getting any type of resolution from the defendants.

They have continually asked to have the case mediation in an attempt to resolve the claims between the plaintiff’s attorneys and the defendant. In essence, the defendants would have to admit their guilt and pay the damages. This would alleviate any worries about being found liable for damages. Mediation usually does not go very well as both sides want the case to be resolved and there is little cooperation on the part of either party.

A class action lawsuit against Dr. Horton is probably going to occur in the near future.

We all know that Dr. Horton is in a very tough position. His personal life is being questioned by those that know the truth about his medical malpractice. It is unknown how this case will proceed but I would imagine that a class action lawsuit will be filed soon.
